DAMAGE IN SHIPPING
UPS is responsible for getting your shippment to you safely. Upon receipt, if you notice or suspect any damage, note so on the delivery papers. DO NOT refuse shippment regardless. If upon opening you find the merchandise damaged due to shipping, call UPS immediately at 1-800-742-5877. Problems of this nature do not happen frequently, but UPS is very responsive in handling claims.
PACKING FEE
A packing fee of $3.00 is charged per order. This small fee is for special packing and preparations.
RETURN MERCHANDISE
If you wish to return merchandise that is UNUSED , you may do so within 10 days of receipt, for a store credit. DO NOT RETURN ANY MERCHANDISE WITHOUT PRIOR APPROVAL. You will be responsible for shipping the merchandise BOTH ways. Merchandise must be unused and in its original, undamaged packing : i.e. it must be resellable as a new product. In all cases, there will be a 15% restocking fee.
SHADE VARIATION
Because variations in shade are inherent in our vitreous tiles. NO claim concerning color or shade will be allowed after the installation of the vitreous tile. Samples, Literature, Color charts and Advertisments are NOT indicative of current stock of material.
TERMS & CONDITIONS OF SALE
GENERAL
All orders are accepted and shipped subject to the following TERMS & CONDITIONS of sale which shall govern any contract entered into by VETRO MOSAICO( the “Seller”) for the sale of its product ( glass mosaic tile ), each shippment of product by the Seller shall be deemed to be only upon these terms and conditions notwithstanding any others which may be contained in any purchase order, acceptance, acknowledgement or other form of communication from the BUYER. VETRO MOSAICO salesperson and agents have NO authority to approve any changes in the current prices of the SELLERS products or in the terms and conditions upon which the product are sold without prior authorization from MANAGEMENT.
PRICES
Product prices found in our latest version of the PRICE LIST, as well as in any other printed publication, are subject to change without prior notice.
TRANSFER OF TITLE/ TRANSPORTATION: Responsibilty For Loss
Whenever VETRO MOSAICO ships our product to a BUYER By COMMON CARRIER, etc, our POLICY is as follows:
Delivery to initial carrier shall constitute delivery to the BUYER. VETRO MOSAICO’s responsibility ceases upon delivery in good order to the carrier and all goods are shipped at BUYERS RISK.
SHIPPING
UPS orders received by 12:00 noon and LTL orders received by 2:00 pm will ship the same day. When faxing your purchase order please, indicate your preferred carrier as all orders are shipped “ FREIGHT COLLECT “ F.O.B. LOS ANGELES, CALIF.
DAMAGES
We are not liable for damage or loss of merchandise once it has left our warehouse. Should this occur, follow these procedures:
UPS SHIPPMENTS
If the shippment shows outward evidence of damage, open the package before signing the delivery form. DO NOT refuse delivery. NOTIFY local UPS distribution center. DO NOT alter the carton or the damaged goods until an inspection by the appropriate agency has been made. The package will be picked up and returned to us. We will then replace or exchange the merchandise.
TRUCK SHIPPMENTS
If damage or loss is evident, indicate it on the carriers delivery form. DO NOT refuse the shippment. FILE a claim IMMEDIATELY with the carrier and then notify us. Keep all packaging materials and the damaged goods until inspection.
SHORTAGES
If incorrect quantities are received, we must be notified within two (2) working days after receipt. FAILURE to do so shall be considered evidence that VETRO MOSAICO has satisfactorily performed its obligations.
CLAIM
VETRO MOSAICO will NOT consider any claim for recovery on materials or labor expenses for material that has been INSTALLED.
Please inspect material PRIOR to installation to insure it is correct size, color, shade, caliber, etc ….
USE CONSTITUTES ACCEPTANCE !
COLOR SAMPLES: Variations in Shades
Shade variation is inherent in all vitreous tile. We will not be responsible for any claims if the glass mosaic tile shipped fails to match reproduction of color lines in literature, color charts,advertisements or samples.
WARRANTY
Seller cannot be held liable for the performance due to BUYERS improper installation or mis-use of product.
TERMS OF PAYMENT
All sales are made on a cash, check, money order basis unless an open account account is established. NO credit is extended to consumer transactions.
Credit will be issued upon receipt of completed credit application and authorized approval by our credit department.
Credit terms are 2% 10 days, net 30 days from date of invoice.
A finance charge of 2% per month will be applied to all invoices not paid within 30 days
JURISDICTION & LEGAL COSTS
Buyer promises to pay VETRO MOSAICO the actual expenditures, including reasonable attorneys fees and court costs should legal proceedings be instituted to collect any amount due.
All transactions made pursuant to these TERMS & CONDITIONS shall be deemed to be made in and shall be governed by the laws of the STATE OF CALIFORNIA in effect at the time the transaction is finalized.
LOS ANGELES, CALIFORNIA has proper jurisdiction over any and all litigations.
